Terms of Service

1. Acceptance of Terms

By accessing or using TrackEDU (“the Service”), operated by Ravlo LLC (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Eligibility & Authorized Use

TrackEDU is intended for use by K–12 educational institutions and their authorized staff. You must be at least 18 years of age and employed by or affiliated with a participating school or district. Access is granted to individuals authorized by a district or school administrator.

3. Description of Service

TrackEDU provides a software platform for tracking, recording, and analyzing student behavior incidents. Features include incident logging, intervention tracking, analytics reporting, notification delivery, and data export tools. We reserve the right to modify, suspend, or discontinue features with reasonable notice.

4. Accounts & Credentials

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. Do not share credentials with others.

5. Acceptable Use

You agree to use the Service only for lawful educational purposes. You must not:

• Use the Service in violation of FERPA, SOPPA, or any applicable student privacy law.
• Enter false, misleading, or defamatory information about any student or staff member.
• Attempt to access data belonging to other districts or institutions.
• Reverse engineer, decompile, or attempt to extract our source code.
• Use the Service to harass, intimidate, or discriminate against any individual.

6. Student Data

Student data entered into TrackEDU is owned by the school or district. We act as a data processor on behalf of the educational institution. We do not sell or monetize student data. Use and protection of student data is governed by our Privacy Policy and any applicable Data Processing Agreement executed with your district.

7. Intellectual Property

All software, designs, logos, and content provided by TrackEDU are the property of Ravlo LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended educational purposes. Data you enter remains yours; by entering it you grant us a license to process it solely to provide the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR CONTINUOUSLY AVAILABLE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RAVLO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOUR DISTRICT IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100.

11. Indemnification

You agree to indemnify and hold Ravlo LLC, its officers, directors, and employees harmless from any claims, losses, or damages arising from your use of the Service in violation of these Terms or applicable law.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration under the AAA rules, except that either party may seek injunctive relief in a court of competent jurisdiction. Class action waiver: you waive the right to participate in class action lawsuits against Ravlo LLC.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to district administrators via email at least 30 days before they take effect. Continued use of TrackEDU after the effective date constitutes acceptance of the updated Terms.
